Terms of Service
Effective Date: September 17, 2026
These Terms of Service ("Terms") govern your use of the website, contact forms, SMS communications, and services provided by Gringo's Construction ("Company," "we," "our," or "us"), a residential construction company serving Dallas-Fort Worth, Texas and surrounding areas.
By accessing our website, submitting a form, requesting an estimate, or using our services, you agree to these Terms.
If you do not agree to these Terms, please do not use our website or services.
If you have any questions about these Terms, you can contact us using the information at the end of this page.
1. Acceptance of Terms
By accessing or using our website, submitting a contact form, calling or texting us, or requesting an estimate or service from Gringo's Construction, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or services.
You must be at least 18 years old to use this website or request services. By using the site or engaging our services, you represent that you are at least 18 years of age and legally able to enter into a binding agreement.
2. Services Provided
Gringo's Construction provides turnkey shed solutions and related residential construction services throughout Dallas-Fort Worth, Texas and surrounding areas.
Our services may include, but are not limited to:
- Shed sales and selection assistance
- Shed delivery
- Shed assembly and installation
- Concrete pads and shed foundations
- Site preparation
- Gravel or alternative shed bases
- Related residential construction and installation services
Our goal is to provide homeowners with a streamlined, turnkey process that may include helping select a shed, preparing or pouring the foundation, delivering the shed, and completing installation.
All services are subject to site conditions, material and product availability, crew availability, scheduling constraints, weather, local regulations, manufacturer availability, and any additional requirements discussed with you before the project begins.
We reserve the right to decline or reschedule any project if conditions are unsafe, impractical, outside our normal scope of work, or otherwise prevent us from reasonably completing the project.
3. Estimates & Pricing
Any estimate we provide is based on the information available at the time, including site visits, measurements, shed selection, plans, photographs, and details you provide to us.
Estimates may outline the expected scope of work, shed or structure, foundation requirements, materials, delivery, installation, and pricing to the best of our knowledge at that time.
Pricing may change if we discover unforeseen conditions or if the scope of work changes.
Examples may include:
- Underground obstacles
- Drainage issues
- Access limitations
- Ground or soil conditions
- Changes to shed size or style
- Changes requested by the customer
- Additional site preparation
- HOA requirements
- Permit or inspection requirements
- Material or manufacturer price changes
- Delivery complications
- Foundation changes
We will communicate significant changes in scope or price and request your approval before proceeding when reasonably possible.
No estimate is considered final or binding until it is agreed to in writing by both you and Gringo's Construction, such as through a signed proposal, contract, invoice, work authorization, or digital acceptance form.
We reserve the right to correct obvious errors in pricing, descriptions, measurements, or website materials.
4. Scheduling & Project Timelines
We will work with you to schedule your project on dates that are practical for both you and our team.
Any timeline we provide is an estimate only and may change based on factors such as:
- Weather
- Extreme temperatures
- Rain
- Concrete curing requirements
- Inspections
- Permitting
- Site conditions
- Equipment issues
- Staffing
- Shed or material availability
- Manufacturer or supplier delays
- Delivery scheduling
Some projects may require the concrete pad or foundation to be completed before shed delivery and installation. Appropriate curing or waiting periods may be required before installation can proceed.
While we do our best to meet agreed-upon timelines, delays can occur that are outside our control.
Gringo's Construction is not liable for indirect costs or damages you may incur due to scheduling changes or delays, such as time off work, rental costs, storage costs, or scheduling of other contractors.
If a delay occurs, we will make reasonable efforts to communicate with you and reschedule the work as soon as practical.
5. Payments
Payment terms will be described in your estimate, proposal, invoice, or work agreement.
Depending on the project, a deposit or initial payment may be required to secure materials, shed orders, delivery, and scheduling, with the remaining balance due according to the terms of the individual project agreement.
By authorizing us to begin work or order materials, you agree to the payment terms described in your agreement for that specific project.
We may accept common payment methods such as:
- Cash
- Check
- Credit or debit card
- Bank transfer
- Other payment methods made available at the time of service
Some payment methods may include processing fees, which will be disclosed when applicable.
All payments must be made in U.S. dollars unless otherwise agreed to in writing.
If payment is not made as agreed, we may pause work, delay delivery or installation, refuse to schedule additional work, charge late fees where permitted by law, and pursue collection or other legal remedies.
You are responsible for reasonable costs of collection, including attorney's fees, to the extent permitted by law.
6. Customer Responsibilities
To help your project go smoothly and safely, you agree to provide Gringo's Construction and its team with reasonable access to the property, including driveways, gates, backyards, work areas, and necessary utilities such as water and electrical power unless otherwise arranged.
You agree to remove or protect personal property, vehicles, landscaping, outdoor furniture, pets, or other items that could interfere with or be affected by the work, where practical.
You are responsible for providing accurate information regarding:
- Property lines
- Easements
- Underground utilities not covered by local utility marking services
- Sprinkler or irrigation systems
- Septic systems
- Drainage concerns
- HOA rules and restrictions
- Access limitations
- Property-specific requirements
- Other conditions that may affect the project
Unless Gringo's Construction specifically agrees in writing to obtain permits, approvals, or HOA authorization on your behalf, you are responsible for obtaining any required permits, approvals, or authorizations before work begins.
7. Concrete, Foundations & Site Conditions
Concrete is a durable building material, but it is subject to natural characteristics and environmental conditions.
Even when installed correctly and according to reasonable industry practices, concrete can develop minor hairline cracks, surface checking, discoloration, or small imperfections over time due to curing, temperature changes, soil movement, moisture conditions, and normal wear and tear.
Minor cracks, color variations, or cosmetic imperfections do not necessarily indicate a structural defect and are not automatically grounds for replacement.
Proper care after installation is important to the long-term performance of the concrete.
This may include:
- Allowing adequate curing time
- Avoiding excessive loads before curing
- Managing drainage
- Avoiding harsh chemicals
- Following any care instructions provided by Gringo's Construction
Gringo's Construction is not responsible for damage caused by misuse, neglect, accidents, extreme weather, soil movement, drainage problems, third parties, or conditions beyond our reasonable control after the project is completed.
The customer understands that site conditions may affect the type of foundation or preparation appropriate for a shed installation.
8. Sheds, Materials & Product Characteristics
Sheds, building materials, roofing materials, siding, paint, lumber, doors, windows, hardware, and other products may have natural or manufacturer-related variations in color, texture, dimensions, appearance, or finish.
Product photographs, catalogs, website images, advertisements, renderings, and samples are intended to provide a reasonable representation of available products but may not perfectly represent the final installed product.
Product availability, colors, styles, dimensions, and manufacturer specifications may change without notice.
Where products or components are manufactured or supplied by third parties, applicable manufacturer warranties may be subject to the manufacturer's own terms, conditions, exclusions, and claim procedures.
9. Warranties & Repairs
Gringo's Construction stands behind the workmanship of the services we provide.
If you believe there is a workmanship issue with your project, you agree to notify us within a reasonable time after noticing the issue so we can review the concern.
We may request:
- Photos or videos
- Documentation
- Project information
- An on-site inspection
Any specific warranties, warranty durations, manufacturer warranties, or repair commitments applicable to your project will be described, if applicable, in your written agreement, proposal, warranty documentation, or other project materials.
Those written project-specific terms will control over any general statements contained on this website.
Normal wear and tear, cosmetic variations, minor concrete cracking, improper maintenance, misuse, unauthorized alterations, damage caused by third parties, extreme weather, drainage problems, soil movement, or other conditions outside our control may not be covered by workmanship warranties.
10. Limitation of Liability
To the fullest extent permitted by law, Gringo's Construction and its owners, employees, contractors, subcontractors, and representatives are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services.
This includes, without limitation:
- Loss of use
- Loss of time
- Inconvenience
- Loss of income
- Scheduling expenses
- Other similar indirect damages
Where our liability cannot legally be excluded, liability will be limited to the maximum extent permitted under applicable Texas law.
Nothing in these Terms is intended to waive or limit rights that cannot legally be waived or limited under applicable law.
